Terms of Use

1. Applicability

1.1. These Terms of Use govern the conditions applicable to the BUYER who purchases ARQBASE PRODUCTS or SERVICES, developed or made available by GORDEEFF ARQUITETURA E TREINAMENTOS LTDA, registered under CNPJ no. 33.449.044/0001-52, headquartered at Avenida José Bonifácio Coutinho Nogueira 214, Suite 636, Campinas – SP, Brazil, ZIP 13091-611.

1.2. For the purposes of this document, the term BUYER covers all persons who purchase ARQBASE PRODUCTS or SERVICES.

1.3. The term ARQBASE PRODUCTS or SERVICES refers to all items developed by GORDEEFF ARQUITETURA E TREINAMENTOS LTDA.

1.4. These Terms of Use will be made available in PDF format together with the purchased products.

2. Binding effect

2.1. By purchasing any of the ARQBASE PRODUCTS or SERVICES, the BUYER agrees to and is legally bound by the provisions of these Terms of Use.

2.2. If the BUYER disagrees with any clause set out in these Terms, they must refrain from purchasing ARQBASE PRODUCTS or SERVICES, thereby avoiding being legally bound by these terms.

3. Usage licences

3.1. The BUYER has the right to use ARQBASE PRODUCTS or SERVICES in their own projects and for their personal or academic development.

3.2. It is prohibited to retransmit, distribute, copy or reproduce, in whole or in part, with or without profit, the material of ARQBASE PRODUCTS and SERVICES without the prior and express authorisation of its legal representatives, under penalty of compensation for moral and material damages, in addition to the sanctions provided for by law.

3.3. Access to the products is personal and non-transferable, for the exclusive use of the BUYER, who assumes full responsibility for its safekeeping, confidentiality and any misuse by third parties.

4. Disclaimer of liability

4.1. The BUYER acknowledges that the performance and/or result of the products may be influenced by several factors, such as the equipment used, the version of the software used to open and edit the files provided, and even the internal settings and/or preferences the user defines for that software. Accordingly, GORDEEFF ARQUITETURA E TREINAMENTOS LTDA is not liable for any issues in the operation of the products arising from these factors.

5. Final provisions

5.1. The BUYER declares, under penalty of law, that they have the legal capacity to accept the terms of this instrument or, in the absence of such capacity, that they are duly represented or assisted by their parents, guardians, curators, legal representatives or equivalent, who assume responsibility for their acts.

5.2. By completing the purchase, the BUYER declares that they have read and fully agree with the terms of use established herein.

5.3. Should the BUYER share the purchased content with third parties or breach any clause of these Terms of Use, GORDEEFF ARQUITETURA E TREINAMENTOS LTDA reserves the right to suspend access to ARQBASE PRODUCTS or SERVICES without any refund or compensation being due, and may also take legal action for breach of contract and copyright infringement.

6. Industrial and intellectual property rights

6.1. ARQBASE PRODUCTS or SERVICES are the exclusive property of GORDEEFF ARQUITETURA E TREINAMENTOS LTDA, constituting protected material under national and international intellectual and industrial property legislation.

7. Lifetime access

7.1. When the purchased product or course is advertised as including lifetime access, it is understood that the BUYER will have the right to use the purchased content for as long as GORDEEFF ARQUITETURA E TREINAMENTOS LTDA and its digital platforms remain in regular operation and compatible with the necessary technical conditions.

7.2. The term "lifetime access" does not mean a guarantee of perpetual operation nor an obligation of access on third-party platforms (e.g. Hotmart, streaming services, external servers), and does not imply a guarantee of eternal availability. Access will be maintained for as long as providing the service remains technically and economically viable.

7.3. In the event of permanent unavailability or definitive shutdown of the platform used to deliver the content, GORDEEFF ARQUITETURA E TREINAMENTOS LTDA undertakes to adopt, within its technical and economic possibilities, at least one of the following measures:

• Migrate the BUYER’s access to a new members area or equivalent environment;
• Provide the BUYER with digital copies of the purchased content for secure download;
• Offer a full or proportional refund, should the previous alternatives prove technically or economically unfeasible.

7.4. In the event of the definitive closure of GORDEEFF ARQUITETURA E TREINAMENTOS LTDA’s activities, it will notify BUYERS at least 30 (thirty) days in advance and implement one of the measures set out in item 7.3, its access obligation being deemed extinguished once the chosen measure is carried out.

7.5. Lifetime access refers exclusively to the content in force at the time of purchase. It does not guarantee access to additional content, courses or products, future updates, new modules, mentorships or bonuses released later, except where expressly stated in the offer or on the sales page.

7.6. Occasional updates or technical improvements to the material may be offered at ArqBase’s discretion, without this implying any obligation to include new content or future versions.
